Under RCW 46.30.020, all Washington drivers are legally required to maintain vehicle liability insurance coverage and provide proof of that coverage if stopped by the police. It doesn’t matter if you are driving your car, or someone else’s, the law states that it is the PERSON that must be insured.
If you cannot provide proof of insurance at the time you are stopped (even if you have insurance), you will probably receive a traffic infraction of $450, or more. This infraction is usually in addition to the infraction you probably received for the offense that led the police to pull you over in the first place (speeding, red light, etc.)
If you receive a No Insurance infraction, and you HAVE INSURANCE, you can usually appear in court (or have an attorney appear for you) pay a small administrative penalty and have the insurance infraction dismissed. If, on the other hand, you didn’t have valid insurance, you need an experienced traffic attorney to fight both the initial infraction and the insurance ticket.
This charge is known as a “document charge.” It typically results from an oversight for the payment of your monthly insurance premium. If convicted, your license will be suspended.
The most misunderstood aspect of this charge is that it applies to whatever car you are driving—not just your own. Additionally, a plea of guilty will result in a license suspension.
